Kerala HC Directs Kochi Corporation to Clear Waste Along Kochi-Panavel Highway After Earlier Order Flouted
The Kerala High Court found that waste cleared pursuant to its November 2025 direction had re-accumulated along the Kochi-Panavel Highway and near a railway overbridge, prompting fresh mandatory directions to the Kochi Municipal Corporation.
A Division Bench of the High Court of Kerala, comprising Justice Bechu Kurian Thomas and Justice Gopinath P., on 27 March 2026 issued a fresh set of directions to the Secretary of the Kochi Municipal Corporation after it came to the court's notice that waste had re-accumulated along the Kochi-Panavel Highway and near a railway overbridge in the Kochu Kadavanthara area — the very locations the court had directed to be cleared by an earlier order dated 13 November 2025. The matter arises from a suo motu writ petition, WP(C) No. 7844 of 2023, initiated by the High Court itself and heard at Ernakulam.
The court's intervention is significant because it reflects a pattern of compliance that did not hold: authorities reported clearance after the November 2025 order, but the waste returned. The bench has now directed not only fresh clearance but also steps to prevent future dumping in the same areas.
The Suo Motu Petition and Its Respondents
The writ petition was initiated by the High Court on its own motion and has drawn in a wide range of public authorities as respondents over successive orders. The original respondents include the State of Kerala represented by the Chief Secretary, the Kochi Municipal Corporation, the Kerala State Pollution Control Board, the District Collector of Ernakulam, the Director General of Kerala Fire and Rescue Services, and the State Police Chief.
Over the course of the proceedings, the court suo motu impleaded additional respondents at different stages: the Principal Secretary, Local Self Government Department (impleaded by order dated 7 March 2023, with the designation later corrected by order dated 27 September 2024); the Kerala State Electricity Board (impleaded 10 March 2023); the National Highways Authority of India (impleaded 18 August 2023); Southern Railways represented by its General Manager, Chennai (impleaded 18 March 2024); and the Municipal Corporation of Thiruvananthapuram (impleaded 15 July 2024).
The breadth of respondents reflects the court's view that waste accumulation along public infrastructure corridors involves multiple agencies with overlapping responsibilities.
What the November 2025 Order Required
By its order dated 13 November 2025, the Division Bench had directed that waste from areas on either side of the Kochi-Panavel Highway, specifically from the B.O.T. Bridge to the Alexander Parambithara Bridge, be cleared. The same order also directed effective steps to clear waste accumulated under the railway overbridge on Anamthuruthichira Road near Kochu Kadavanthara.
Following that direction, it was reported to the court that the waste had been cleared. The matter came up again on 6 March 2026, and by the time of the 27 March 2026 hearing, the bench recorded that waste had once again accumulated in those areas.
The Court's Reasoning for Fresh Directions
Justice Bechu Kurian Thomas, writing the order on behalf of the bench, recorded that it had “come to our notice that in those areas the waste have again accumulated.” The court treated this recurrence as sufficient reason to issue a further direction rather than treat the matter as closed.
The bench's approach reflects a concern that one-time clearance without preventive measures is inadequate. The fresh directions therefore go beyond mere clearance and include a specific instruction to take steps to avoid further dumping in the same locations. This addition — absent from the November 2025 order as described in the digest — signals that the court expects the Corporation to address the root cause of re-accumulation, not merely respond to it after the fact.
The hearing on 27 March 2026 was attended by the Advocate General Sri K. Gopalakrishna Kurup and Special Government Pleader Sri C.E. Unnikrishnan for the State of Kerala, the District Collector, the Fire and Rescue Services, the State Police, and the Local Self Government Department. Standing counsel appeared for the Kochi Municipal Corporation and the Kerala State Pollution Control Board. The Deputy Solicitor General of India and Senior Central Government Counsel appeared for the NHAI and Southern Railways. Amici curiae Sri Vinu T.V., Sri Vishnu S., and Smt. Pooja Menon also addressed the court, as did Sri Mohammed Shah and Sri C.L. Anto appearing as parties in person.
Directions Issued to Kochi Corporation
The bench issued three specific directions to the Secretary, Kochi Municipal Corporation:
First, urgent steps are to be taken to clear all waste from the areas on either side of the Kochi-Panavel Highway from the B.O.T. Bridge to the Alexander Parambithara Bridge.
Second, effective steps are to be taken to clear the waste accumulated near and under the railway overbridge on Anamthuruthichira Road near Kochu Kadavanthara.
Third, effective steps are to be taken to prevent further dumping of waste in those areas going forward.
The matter has been posted for the next hearing on 29 May 2026.
