Rajasthan HC Stays CAT Jaipur Order Against Navodaya Vidyalaya Samiti in Service Dispute
A Rajasthan High Court Division Bench has stayed Paragraph 4 of a Central Administrative Tribunal, Jaipur order dated 25 August 2026 while issuing notice to Navodaya Vidyalaya Samiti, returnable on 23 September 2026.
The High Court of Judicature for Rajasthan, Bench at Jaipur, on 3 September 2026 issued notice to the Commissioner, Navodaya Vidyalaya Samiti and stayed a specific direction contained in an order of the Central Administrative Tribunal (CAT), Jaipur. The matter arises from D.B. Civil Writ Petition No. 17702/2026 filed by Kavita Bhati, wife of Vijender Singh, challenging an order the CAT had passed in a connected original application. A Division Bench comprising Justice Inderjeet Singh and Justice Sandeep Taneja passed the interim order after hearing the petitioner's counsel.
The CAT Order Under Challenge
The CAT, Jaipur had passed an order dated 25 August 2026 in Original Application No. 777/2026, titled Vijaypal Saini v. Navodaya Vidyalaya Samiti. Kavita Bhati's writ petition takes issue with Paragraph 4 of that order. The digest does not set out the text of Paragraph 4 or the nature of the service dispute underlying OA 777/2026, but the Division Bench considered the challenge sufficient to warrant an interim stay of that paragraph pending notice to the respondent.
The petitioner is represented by Mr. Sunil Samdaria. No counsel had entered appearance for the respondent at the time of the order, though Mr. Krishan Verma ordinarily appears for Navodaya Vidyalaya Samiti in such matters before this court.
What the Division Bench Directed
The bench directed that the operation of Paragraph 4 of the CAT order dated 25 August 2026 “shall remain stayed” until further orders. Notice was issued to the respondents, returnable by 23 September 2026.
Counsel for the petitioner was directed to supply a copy of the writ petition along with all its annexures to the office of Mr. Krishan Verma, who has been shown as counsel for the respondent in the cause-list. The office was separately directed to record Mr. Verma's name in that capacity.
The matter is listed for hearing on 23 September 2026.
Outcome
D.B. Civil Writ Petition No. 17702/2026 is admitted for notice. Paragraph 4 of the CAT Jaipur order dated 25 August 2026 in OA 777/2026 stands stayed in the interim. The next date before the Division Bench of Justice Inderjeet Singh and Justice Sandeep Taneja is 23 September 2026.
