Sikkim HC Directs DPC for BRO Engineer Blocked from Promotion by Vigilance Enquiry
The Sikkim High Court ordered a Departmental Promotion Committee to consider a Border Roads Organisation Superintending Engineer for Chief Engineer after vigilance clearance was technically granted.
The High Court of Sikkim, sitting at Gangtok, disposed of a writ petition filed by Shri Navneet Kishore Dixit, a Superintending Engineer (Civil) with the Border Roads Organisation (BRO), directing the constitution of a Departmental Promotion Committee (DPC) within eight weeks to consider his promotion to the post of Chief Engineer. Chief Justice A. Muhamed Mustaque, sitting singly, passed the judgment on 22 May 2026. The case turned on the fact that a pending vigilance enquiry had kept the petitioner out of promotion consideration even as similarly situated colleagues were promoted, and that the vigilance clearance had since been technically granted by the time the matter reached final hearing.
The Dispute Before the Court
Navneet Kishore Dixit, aged about 58 years and presently posted as Superintending Engineer (Civil) at HQ Swastik, Gangtok, under the Ministry of Defence, filed WP(C) No. 02 of 2026 before the Sikkim High Court. His grievance was that there were more than ten vacancies in the cadre of Chief Engineer in the BRO, and he was due to be considered for promotion to that post. The sole obstacle was a pending vigilance enquiry, on account of which the respondents — the Union of India through the Secretary, Ministry of Defence; the Director General Border Roads; and the Joint Secretary (BR), Ministry of Defence — had not placed him before a DPC.
Senior Advocate Mr. Sudesh Joshi, appearing with Mrs. Manita Pradhan and Mr. Adarsh Gurung for the petitioner, pointed out that many others who were similarly situated had been considered for promotion and promoted while this litigation was pending. The petitioner also pressed for certain monetary benefits said to be due since January 2023, which had been withheld on account of administrative reasons arising from the vigilance enquiry.
Interim Protection Ordered in February 2026
The matter had come up for an interim hearing on 19 February 2026. At that stage, the Deputy Solicitor General of India informed the Court, on instructions, that ten vacancies existed in the Chief Engineer cadre. The Court directed that one of those vacancies be kept vacant pending a final decision, while permitting the respondents to proceed with promotions against the remaining vacancies. The Court also directed that all other promotees be informed of the pendency of the litigation, and that inter-se seniority would be subject to the final outcome. The matter was then listed for 6 April 2026.
Vigilance Clearance Granted Before Final Hearing
By the time the matter was taken up for final disposal on 22 May 2026, the position had materially changed. Ms. Sangita Pradhan, Deputy Solicitor General of India, appearing with Ms. Natasha Pradhan and Mr. Amit Kumar Sharma for the respondents, submitted that the vigilance clearance had been technically granted and that there was no longer any impediment to considering the petitioner for promotion to the post of Chief Engineer.
Senior Counsel for the petitioner reiterated the claim for monetary benefits due since January 2023 that had been withheld on account of the vigilance proceedings.
How the Court Reasoned
Chief Justice Mustaque took note of the concession by the respondents that vigilance clearance had been technically granted. With that impediment removed, the Court saw no basis to withhold a direction for the DPC process to be initiated. The judgment directed the constitution of a DPC to consider the petitioner for promotion in accordance with the relevant Rules.
On the question of monetary benefits, the Court directed that if any such benefits were found to be due — having been withheld on account of administrative reasons arising from the vigilance enquiry — they shall be considered for disbursal without delay.
On seniority, the Court directed that if the petitioner is found eligible and promoted to the post of Chief Engineer, his inter-se seniority shall be fixed in accordance with his seniority. This direction is consistent with the protection already built into the February 2026 interim order, which had made the seniority of all promotees during the pendency of the writ subject to the final decision.
Outcome
WP(C) No. 02 of 2026 was disposed of on 22 May 2026. The respondents are directed to constitute a DPC to consider Navneet Kishore Dixit for promotion to the post of Chief Engineer in accordance with the relevant Rules. The entire process must be completed within eight weeks. Any monetary benefits found to be due and withheld on account of the vigilance enquiry are to be disbursed without delay. If promoted, his inter-se seniority is to be fixed in accordance with his seniority. The judgment has been approved for reporting.
