The company told the auditors its sewage pumps were built differently from water pumps, and the Tribunal held it to that

Dr Ajaya Krishna Vishvesha and Satendra Vikram Singh sustained a ₹63.69 lakh excise demand on sewage and drainage pumps but set aside the penalty, the department having itself pushed the assessee onto the concessional rate.

The West Zonal Bench has held that sewage and drainage pumps are not "power driven pumps primarily designed for handling water" within Sr. No. 235 of Notification 12/2012-CE, sustaining a differential excise demand of ₹63,69,295 against Lubi Industries LLP. What sank the appellant was its own answer to the audit objection, in which it had said that its sewage pumps differ in technique and manufacturing process from pumps made for water. The penalty, however, was set aside: the appellant had been paying full duty until the department told it not to.

The transaction

Lubi Industries LLP manufactures mono block and submersible pumps along with sewage and drainage pumps, all falling under heading 8413 of the Central Excise Tariff Act, 1985. On the sewage and drainage pumps it paid duty at the full rate until March 2016. From April 2016 it began claiming the concessional 6 per cent rate at Sr. No. 235 of Notification 12/2012-CE dated 17 March 2012, which covers power driven pumps primarily designed for handling water.

It did not reach that position on its own. On the appellant's account, it switched to the concessional rate on the insistence of the audit officers and the range officer.

The show cause and the orders below

On 11 April 2018 the department issued a show cause notice proposing to deny the notification and to recover differential duty of ₹63,69,295 under Section 11A(1) of the Central Excise Act, 1944, with interest under Section 11AA and penalty under Rule 25(1) of the Central Excise Rules, 2002 read with Section 11AC(1)(a).

The Additional Commissioner adjudicated it on 31 January 2019, confirming the duty and interest and imposing an equal amount of penalty. The differential duty had already been paid under protest, and that protest was vacated and the amount appropriated. The Commissioner (Appeals) upheld the demand and interest on 23 July 2020 but reduced the penalty.

The legal question

The dispute reduces to one question: are sewage pumps and drainage pumps primarily designed for handling water?

The appellant's case was that the notification says "water" and nothing more. It does not say clean water. Sewage and drainage water is still water in common parlance, impurities notwithstanding, and there was no evidence that its pumps are known in the trade as pumps for other liquids or for sludge containing hard material. It leaned on Modi Industries Ltd., where the Tribunal drew the distinction that carries the argument: the notification exempts pumps primarily designed for handling water, not pumps designed solely or exclusively for it. Water in most forms contains impurities, dissolved or suspended; only distilled and demineralised water does not. Any pump drawing from a natural or industrial site is pumping water with foreign matter in it, and once the difference between "primarily designed" and "exclusively designed" is grasped, a pump handling water containing foreign matter qualifies.

The Bench approached the words as a question of trade usage rather than science. In Indo-International Industries the Supreme Court held that unless a term is defined in the statute, a tariff entry is to be read not in its scientific or technical sense but in the popular sense — the sense in which those dealing in the goods understand it — and held on that basis that clinical syringes and thermometers are not "glassware" commercially even though made of glass. Delhi Cloth and General Mills is to the same effect: in a fiscal statute, words are construed as the trade, the dealer and the customer understand them, and that understanding is the definitive index of legislative intention. The Bench also found the advance ruling in Aqua Machineries P. Ltd. relevant although it arose under the goods and services tax, because it held that "water" is understood as clear or raw water and not as sewage, in common and commercial parlance alike, and because the notification itself uses the two terms separately.

Then came the admission. In answering the audit objection the appellant had itself contended that there is a wide difference in technique and manufacturing process between power driven pumps for handling water and those for other liquids or sludge containing hard materials; that suction and delivery of muddy sewage water is controlled and restricted; that the Board had held as long ago as 1972 that a mud or dredging pump pumps silt and water and was therefore outside the water-pump entry of the day; and that the relevant ISO specification describes an electric monoset pump for clear, cold water for agriculture and water supply.

Faced with that, the appellant produced a chartered engineer's certificate dated 15 May 2026. The Bench found it did not meet the point. It said nothing about whether the design of sewage and drainage pumps is similar to or different from that of water pumps; it certified only that the design, construction and technical parameters of the models in question allow them to be used as drainage water pumps and also for normal or clean water. Against the appellant's own admission that the designs differ, that was not enough, and Modi Industries was distinguished.

The burden point finished it. In a concessional notification it is for the assessee to show that its goods fall within the four corners of the notification, an exemption in a fiscal statute is construed strictly and given effect by the clear and unambiguous words used, and nothing may be added to or subtracted from those words.

Outcome

The differential duty of ₹63,69,295 is sustained, with applicable interest.

The penalty is not. The Bench noted the sequence: the appellant was initially paying duty at the full rate and began claiming the concessional rate only after the audit raised the point, whereupon the department took a U-turn and demanded the differential duty from it. On that record there was no evidence against the appellant warranting a penalty equal to 10 per cent of the duty, and the penalty imposed by the Commissioner (Appeals) was set aside. With that modification the order under appeal is upheld and the appeal partly allowed. Pronounced in open court on 13 October 2026, the matter having been heard on 13 April 2026.
